DPP abusing his powers to favour Hichilema’s friends – Mwamba
PF chairperson for information and publicity Emmanuel Mwamba has charged that Director of Public Prosecutions (DPP) Gilbert Phiri has amended the charge from murder to manslaughter for the sole purpose of ensuring that Maria Zaloumis was granted bail and freed for now.

Mwamba accused Phiri of abusing his powers of DPP to favour the friends of President Hakainde Hichilema.
“In many cases against former Government officials, Phiri opposes bail, he seeks maximum punishment for offenders, never seeks rational, lenient or favourable charges,” Mwamba stated. “He even appeals against cases where accused persons have won cases such as the Honey Bee or Lt. Gen Eric Chimese’s cases. He lays and approves obnoxious and oppressive charges such as the draconian charges of sedition against critics of the President.”
Mwamba stated that within a short period, Phiri found it wise, despite strong evidence, to unilaterally reduce charges from murder to manslaughter and did not oppose bail, and did not object to the flight risk of the foreigner in the matter.
“Kabwe Magistrate Wamundila Liswaniso was on hand to grant bail with utmost favourable conditions,” stated Mwamba. “May the soul of Enoch Simfukwe rest in eternal peace.”
Criminal law is simple. So simple even a fugitive former fimo fimo who is now a career twister of narratives will fail to understand.
The charge of murder requires the prosecution to establish intention. If they can not establish intention, it becomes manslaughter. As long as the accused has fixed abode and the judge can find no readon to think the accused is a flight risk, manslaughter is bailable.
Intention is the key component in first degree. The witch doctors from Mozambique left Mozambique with the intention to kill HH. Even if the method to carry out the act failed, they were convicted because intention was established beyond reasonable doubt.
Even Jesus said if you look at a woman lustfully, you have already committed adultery with her.
INTENTION.
The State would have clearly lost this case if the charge of murder was maintained. And Zed Farmer would have walked free. As it stands, the charge of manslaughter will win the state the case. And Zed Farmer will be locked up to serve the required sentence. This completely overturns the narrative that Muamba is pushing.

If you or anyone picks up a gun and fires at someone, clearly the intention is to kill. The court proved that Shebby had every intention to kill. Go and read the court judgement. It is in the public domain. And why did the accused flee to Ethiopia? He was for a time being harboured by Muamba himself. This case only came to light after PF was kicked out. Very shameful that you support the murder of people. This is why PF will NEVER EVER get back to power. You are murderers and thieves.
In other words, intention at law is called ‘mens rea’ or guilty mind. The act is called ‘actus rea’. But it is proving beyond reasonable doubt where a DPP has to consider whether murder or manslaughter charge.
